Résumé: "موضوع هذه الدراسة موسوم بعنوان ""وضع مقاصد الشريعة في فقه الأقليات -دراسة تطبيقية لنماذج مختارة-""، في محاولةٍ للإجابة على إشكاليته الرئيسية وهي مدى قدرة الفقه الإسلامي على مواجهة التغيرات الواسعة التي يشهدها واقعنا المعاصر في شتى ميادين الحياة، وإيجاد حلول مناسبة للمشكلات التي تعترضه خلالها، خاصة ما تعلق منها بالأقليات المسلمة في الدول الغربية، وهل هذا التغيير واعتبار خصوصية المكان يتعارض مع شمولية الشريعة وصلاحيتها لكل زمان ومكان. وقد جاء الموضوع في ثلاثة مباحث: خُصِّص أولها لبيان مفاهيم مصطلحات الدراسة، وعُنِيَ ثانيها بالتأصيل لفقه الأقليات، بينما سلَّط ثالثها الضوءَ على بعض المسائل التطبيقية في فقه الأقليات. ومن أهم النتائج التي توصَّل إليها البحث أن فقه الأقليات ليس مرادفا لفقه الترخص، وإنما هو يراعي كلا من فقه المقاصد وفقه الموازنات وفقه الأولويات، بالإضافة إلى فقه المآلات، ولا يعني بحال من الأحوال التنازل عن الثوابت التي وضعها الإسلام، وتعارفت عليها الأمة."The title of thisstudy is ""the situation of the purposes of the Shariah in the jurisprudence of minorities, -a practicalstudy of selectedmodelsisdiscussed-"", aiming to answerits main problemthatis: to whatextant the Islamic jurisprudence cancopewith the variouscontemporary changes in differentfields of life and to findsuitable solutions to the facingproblemsespciallypertaining to Moslimminorities in Western countries. Also, if that changes, regarding to the private place, contradictwith the totality of the Shariah and itsvalidity for every time and place? This dissertaioniscomposedofthreechapters. The first chapterpresents the concepts and terms of study. The second one clarifies the development of the jurisprudence of minorities. While the third one highlightssomepractical issues in the minority jurisprudence. One of the most important findings of the researchisthatminority jurisprudence is not similar to licensed jurisprudence, but ratherittakesintoaccountits jurisprudence of intents, balances, priorities and interpretation. However, the Islamic constants are considered as the basics which have been recognized by the nation.
