الضوابط القانونية لحماية المستهلك بين حتمية التطور وخطورة استخدام تقنية النانو وفق القانون 09-03

Résumé: إن انتشار تقنية النانو في المجال الغذائي بمقاييسها المتناهية في الصغر راجع إلى تطبيقاتها في تصنيع منتجات غذائية "Nanofood "، ذات خصائص مبتكرة للوصول إلى أعلى مستوى من الجودة، وفي غمرة اتساع دائرة هذه التقنية بدأت تظهر دراسات تؤكد خطورة المنتجات المصنعة وفقا لتقنية الجيل الخامس، مما يستدعي ضرورة تطبيق النصوص القانونية وتفعيل دائرة الرقابة على هذه التكنولوجيا، إضافة إلى إلزامية إعلام المستهلك بخبايا هذه المنتجات الغذائية المعروضة للاستهلاك من طرف المتدخل وفقا لنصوص قانون حماية المستهلك وقمع الغش 09-03. وتهدف الدراسة الى تحديد مساوئ هذه التقنية على صحة المستهلك، وأيضا سلامة هذه المنتوجات وكذا الحث على اضفاء الحماية القانونية على المستهلك من هذه التقنية. الكلمات المفتاحية: حماية المستهلك؛تقنية النانو؛ منتجات غذائية؛ مجال غذائي،تصنيع . Abstract: The spread of nanotechnology in the field of food by micro-scale refers to the applications in the manufacture of food products, "Nanofood", with innovative properties to reach the highest level of quality, and in the widening of the circle of this technology began to show studies confirm the seriousness of products manufactured according to the technology of the fifth generation, Which necessitates the need to apply the legal texts and activate the control department on this technology, in addition to the obligation to inform the consumer of the hidden food products offered for consumption by the party in accordance with the provisions of the Consumer Protection and Suppression Act 09-03.
