تطور قواعد حماية البيئة في القانون الدولي الإنساني

Résumé: تتناول هذه الورقة مراحل تطور قواعد القانون الدولي الانساني المتعلقة بحماية البيئة . وتستعرض القواعد القانونية المكتوبة التي توفر الحماية للبيئة ولكن بطريقة غير مباشرة وصولا إلى القواعد القانونية التي تذكر بشكل صريح وواضح ضرورة حماية البيئة أثناء الصراع المسلح . والفرضية الاساسية التي تطرحها هذه الورقة هي ان القواعد الدولية المتعلقة بحماية البيئة تتطور بتطور نوعية الأسلحة الحربية وبالتالي لايمكن التنبؤ بقواعد دولية جديدة تحمي البيئة خلال الحروب إلا بعد ظهور الاسلحة الجديدة واستخدامها فعليا وإن على سبيل التجربة. This paper deals with the evolution of the rules of international humanitarian law related to the protection of the environment. It reviews the written legal rules that provide protection for the environment, but indirectly, up to the legal rules that explicitly mention the need to protect the environment during armed conflict. The basic hypothesis put forward by this paper is that international rules related to the protection of the environment evolve with the development of the quality of military weapons, and therefore it is not possible to predict new international rules that protect the environment during wars until after the emergence of new weapons and their actual use, even if on an experimental basis.
