جرائم الإهمال العائلي في التشريع الجزائري

Résumé: الأسرة هي الركيزة الأساسية والاولى في المجتمع، إذا صلحت صلح المجتمع وإذا فسدت فسد المجتمع، فهي تتكون من أفراد تربطهم صلة القرابة أو الزوجية، ونظرا لأهميتها أصبحت مصدر اهتمام كل القوانين والتشريعات التي تهدف بشكل متواصل لوضع قواعد وقوانين قصد حماية الأسرة. إلا أن عدم الالتزام بالواجبات العائلية داخل الأسرة يؤدي إلى الإخلال بتوازنها ينتج عنه الإهمال العائلي، الذي ينتهك حرمتها ويمتد إلى فكها وتشتيت شملها، وهي من أكثر الجرائم انتشارًا في المجتمع، مما جعل المشرع الجزائري يقوم بوضع آليات وقوانين للحد منها وتجريم كل الأفعال التي تؤدي إلى إهمال الواجبات المادية منها والمعنوية. وقد تناول المشرع صور الإهمال العائلي في قانون العقوبات في المواد 330 ،331، 332 وهي ترك مقر الأسرة، التخلي عن الزوجة الحامل والإهمال المعنوي للأولاد، التي تصنف من الجرائم المعنوية، أما المادية فتشمل جريمة عدم تسديد النفقة. حيث تعتبر كل جريمة من هذه الجرائم قائمة بذاتها حددها المشرع سواء من ناحية إجراءات المتابعة أو من ناحية العقوبات المقررة من حبس وغرامة، الهدف منها تحقيق الحماية للحقوق والواجبات العائلية والحفاظ على العلاقة القائمة بين أفرادها. الكلمات المفتاحية: الاسرة- الاهمال العائلي- النفقة-الحقوق والواجبات العائلية Abstract: The family is the first and main pillar of society. It consists of individuals linked by kinship or marriage; due to its importance it has become the source of attention of all laws and legislation that continuously aim to establish rules and laws in order to protect the family. However, non-compliance with family duties within the family leads to disruption of its balance, resulting in family neglect, which violates its sanctity and extends to its disintegration and disintegration, which is one of the most widespread crimes in society, which made the Algerian legislator develop mechanisms and laws to limit it and criminalize all acts that lead to neglect of material and moral duties. Articles 330, 331 and 332 of the Penal Code deal with the forms of family neglect, namely abandonment of the family seat, a pregnant wife and moral neglect of children, which are classified as moral offences, while material offences include the offence of non-payment of maintenance, each of these offences is a stand-alone offence defined by the legislator, both in terms of prosecution procedures and in terms of the prescribed penalties, including imprisonment and fines, with the aim of protecting family rights and duties and preserving the relationship between family members.
