أحكام المعاملات المالية للأقليات المسلمة ـ نماذج مختارة ـ

Résumé: "ملخص: جاءت هذه الدراسة بعنوان: ""أحكام المعاملات المالية للأقليات المسلمة""، وهي تبحث في أحكام بعض المعاملات المالية للأقليات الإسلامية، منطلقة من اشكالية رئيسية كانت كالآتي: ما هي أحكام ممارسة الأقليات المسلمة لبعض المعاملات المالية للأقليات الإسلامية في بلاد غير الإسلام؟. وللإجابة على هذا التساؤل رسمتُ خطة كانت من مبحثين؛ حيث عُني المبحث الأول ببيان الجزء النظري للمعاملات المالية والأقلية المسلمة، بينما اختص المبحث الثاني ببيان الجزء التطبيقي لبعض المعاملات المالية للأقلية. توصلتُ في نهاية دراستي إلى نتائج أهمها: أن جانب فقه المعاملات المالية من أوسع الجوانب وأكثرها مرونة وتجدداً، وهذا التجدد يمتد ليشمل حياة الأقليات في المجتمعات الغربية وهذا ما يستدعي من الفقهاء والمختصين متابعة ذلك التجدد بما يلائمه من أحكام وفق منظور الشريعة ومقاصدها، ومع مراعاة أوضاع تلك الأقليات وأحوال المجتمعات التي يعيشون فيها. " "Abstract: This study is entitled as: "" The provisions of the financial transactions of Muslim minority "". It searches in the provisions of some financial transactions of Islamic minorities. The statement of problem is as follow: what are the provisions of Muslim Minorities' practices some finacial transactions of Islamic Minorties In the non Islamic statse? To Answer this question, the study is divided into two chapters,The first chapter focuses on the theoretical side with a background knowledge about the topic whereas the second chapter will be dealing with the practical side of the financial transactions of the Minority. The findings show that fiqh of financial trasactions is the most expanded, largest, and renewal side. This renewal includes minorotiesm' lives in the westrern sociteties thats why jurists and spesialsts should follwo it up with suitable Islamic provisions taking into considearation Minorities status and their societies circumstances. "
