حماية مستهلك المنتجات الغذائية في التجارة الإلكترونية ، بين التشريعات القانونية والممارسة الميدانية .

Résumé: تهدف هذه المداخلة الميدانية إلى التعرف على شروط ممارسة التجارة الإلكترونية والمتطلبات المتعلقة بالمعاملات التجارية الإلكترونية كما تسعى إلى رصد أهم آليات حماية المستهلك الإلكتروني في التشريع الجزائري والوقوف على حدود معرفة المستهلك الإلكتروني لحقوقه وواجباته القانونية بالإضافة إلى التطرق إلى خصوصية المنتجات الغذائية وكذا الشروط الواجب توفرها في هذا النوع من المنتجات، وذلك من خلال قراءة للنصوص القانونية في هذا المجال وأيضا توزيع استمارة الكترونية على عينة قصدية بالاستعانة بمنهج المسح. بعد الدراسة النظرية و الميدانية لهذا الموضوع توصلنا إلى أن المشرع الجزائري قد استحدث آليات لحماية المستهلك الالكتروني و التي لا يعرفها معظم المبحوثين، كما اقر مجموعة ضوابط لممارسة النشاطات التجارية الالكترونية وتبين لنا بان هذه النشاطات التجارية الالكترونية الموجودة حاليا لا تتوافق و الضوابط المنصوص عليها قانونا This field intervention aims to identify the conditions of the practice of e-commerce and the requirements related to e-commerce transactions as well as to monitor the most important mechanisms of electronic consumer protection in Algerian legislation and to determine the limits of the consumer's electronic knowledge of its legal rights and duties, in addition to addressing the specificity of food products and the conditions to be met in this type of product, through a reading of legal texts in this area and also the distribution of an electronic form on a sample intended to use the survey method. After the theoretical and field study of this subject, we concluded that the Algerian legislator has developed mechanisms to protect the electronic consumer, which most of the researches do not know, as he approved a set of controls for the practice of electronic business activities and found that these existing e-business activities do not comply with the regulations stipulated in law.
