واقع الاستقلال الوظيفي للبرلمان الجزائري على ضوء التعديل الدستوري2016

Résumé: تهدف هذه الدراسة إلى تحديد العلاقة الوظيفية بين البرلمان والسلطة التنفيذية، ومجالات تفوّق هذه الأخيرة، ومن ثمّ انعكاس ذلك على البرلمان خاصة في مجال ممارسة التشريع، إذ يعتبر تبنّي المؤسّس الدستوري الصريح لمبدأ الفصل بين السلطات بعد تعديل 2016 من الضمانات الأساسية لقيام علاقة تعاون متبادلة بين السلطتين التنفيذية والتشريعية، كما يعدّ ضمانة لاستقلال البرلمان في ممارسة وظيفة التشريع كاختصاص أصيل. وقد توصّلت الدراسة إلى أنّ الواقع العملي ومن خلال تراجع دور البرلمان، وتعاظم دور السلطة التنفيذية أثبت أنّ هناك عدة قيود تحول دون قيامه بدوره الحقيقي في ممارسة العمل التشريعي، خاصّة في ظلّ مشاركة رئيس الجمهورية لهذا الاختصاص، وتدخّل الحكومة في مختلف مراحل العملية التشريعية، بعيدا عن وجود ضمانات كافية تحدّ من هيمنة السلطة التنفيذية. This study aims to determine the functional relationship between parliament and executive power, its areas of supremacy, and its reflection on parliament in the practice of legislation, the principle of separation of powers after the 2016 amendment being considered as the 'one of the fundamental guarantees of a relationship of mutual cooperation between the executive power and the legislative power, and a guarantee of the independence of parliament in the exercise of the function of legislation as an essential competence. The study found that the practical reality of the declining role of parliament and the growing role of the executive branch proved that there are several restrictions that prevent it from practicing legislative work, especially with the participation of the President in that jurisdiction, and government interference in legislative stages, Without guarantees that limit the hegemony of executive power.
