مواجهة الجريمة المعلوماتية في التشريع الجزائري

Résumé: إن التطور الحاصل في تكنلوجيا الإعلام و الإتصال ، و ظهور شبكة الإنترنت بكل ماحملته من تقدم و خدمات لم يمر على العالم بسلام ، لأنه بقدر ما أحدث آثار إيجابية و غير نمط حياة الجتمعات و ساهم في التطور و الرقي في جميع المجالات و لاسيما المعاملات الإلكترونية ، بقدر ماكان له أثر سلبي على حياة الناس و مصالح الدول ، كل هذا تجلى في تطويع الإنترنت و الوسائل الإلكترونية لتكون عالما من عوالم الجريمة ، وهكذا ظهرت إلى الوجود الجرائم المعلوماتية بشتى أنواعها ﮳ و يعد الإجرام الإلكتروني واحد من أخطر الظواهر الإجرامية المستحدثة في المجتمع الجزائري ، كما في المجتمعات الأخرى ، حيث شهدت الألفية الأخيرة ثورة تكنلوجية إستغلها الأشراف كما الأشرار في تحقيق دوافع مشينة أحسنها الشغف بالتقنية و أسوءها الربح المادي ، لهذا كان لزاما على المشرع الجزائري التدخل عبر عديد النصوص القانونية الموضوعية و الإجرائية لمواجهة الجريمة و المجرم المعلوماتي The development in information and communication technology , and the emergence of the internet with all its progress and services , did not pass the world peacefully , because as much as it has had positive effects and changed the lifestyle of societies and contributed to the development and advancement in all areas , especially electronic transactions , as much as it had a negative impact on the lives of people and the interests of counntries , all this was evident in the adaptation of the internet and electronic means to be a world of crime worlds , and soi t came into existence ﮳ electronic crimes of all kinds , and we will try , in our research , to address the development of electronic transaction , and who has been difined as what is electronic crime and what are the mechanisms to combat it Cybercrime is one of the most dangerous criminal phenomena developed in Algerian society as well as in other societies , as the last millennium witnessed a technological revolution that was exploited by supervision as well as by villains to achieve disgraceful motives , the best of with was the passion for technology and the worst of whith was material profit , so as it was nessessary for the Algerian legislator to intervene through numerous substantive legal texts and procedural to confront the crime and the cyber criminal
