عيوب الإرادة في عقود التجارة الإلكترونية

Résumé: تعالج هذه الدراسة، الأحكام والقواعد التي تنظم عيوب الارادة في العقود المبرمة عبر الوسائط الإلكترونية، حيث لا يكفي تطبيق قواعد القانون المدني رغم أنها تمثل القواعد والأحكام العامة، بسبب خصوصية و طبيعة المعاملات في العالم الافتراضي التي يكثر فيها حدوث الغلط و الاستغلال و التدليس ، ما جعل المشرع يتدارك الأمر بإصداره عدة نصوص قانونية تنظم المعاملات و العقود الإلكترونية من أهمها قانون التجارة الإلكترونية، الذي حاول من خلاله المشرع اعطاء الضمانات الكافية لتعاقد آمن عبر الوسيط الإلكتروني، غير أنه تضمن أحكام خلقت لبساً وغموضاً و إشكالات نحاول استعراضها و إيجاد الحلول الممكنة لها في هذه الدراسة. This study deals with the provisions and rules that regulate flaws of will in contracts concluded via electronic media, as it is not sufficient to apply the rules of civil law, even though they represent general rules and provisions, due to the specificity and nature of transactions in the virtual world where error, exploitation and fraud are common. To make the legislator avoid the issue by issuing several legal texts regulating electronic transactions and contracts, the most important of which is the e-commerce law, through which the legislator tried to give sufficient guarantees for a secure contract through the electronic medium, but it included provisions that created confusion, ambiguity and problems we try to review and finding possible solutions for her in this study.
