الآليات المستحدثة لضمان القروض العقارية في التشريع الجزائري

Résumé: ان أزمة السكن تؤرق كافة الأف ا رد نتيجة عدم حصولهم على مبالغ مالية كافية تمكنهم من ش ا رء مسكن لذا يلجأون الى طلب الحصول على قروض بنكية من أجل ش ا رء سكن جديد أو ترميم سكن قديم أو بناء سكن وطالما أن البنوك تقدم قروضا عقارية لطالبيها فيجب عليها ان تتخذ الحيطة والحذر، وتعمل على تقديم ضمانات شخصية أو عينية من المستفيد، الا أن الواقع أثبت عدم كفاية هذه الضمانات التقليدية لتغطية مخاطر القرض العقاري بسبب التحولات الاقتصادية والتجارية التي تشهدها الدول وهذا ما أدى بالمشرع لإيجاد آليات جديدة تساعد على توفير السيولة والإئتمان وتتمثل في إعادة التمويل الرهني، وضمانات مستحدثة مكملة للضمانات التقليدية ومثال ذلك تأمين القرض وشرط الإحتفاظ بالملكية كضمان.The housing crisis afflicts all individuals as a result of not obtaining sufficient amounts of money to enable them to buy a house, so they resort to requesting bank loans in order to buy a new house, restore an old one, or build a house, and as long as banks provide real estate loans to their applicants, they must take caution and caution It works to provide personal or in-kind guarantees from the beneficiary, but the reality has proven that these traditional guarantees are insufficient to cover the risks of the mortgage loan due to the economic and commercial transformations taking place in the countries, and this is what led the legislator to find new mechanisms that help provide liquidity and credit, represented in mortgage refinancing, and guarantees Innovative and complementary to traditional guarantees, for example, loan insurance and the condition of retaining ownership as collateral.
