الاعتبارات البيئية في قانون التعمير بين حتمية النص عليها وإشكالات الإعمال بها

Résumé: تهدف قواعد البناء إلى ضبط وتنظيم عمليات شغل الأراضي بمختلف مظاهرها، في حين أن البيئة هي الحاوية التي تحتوي على هذه العمليات وتتأثر بها، الأمر الذي يتطلب تطوير خيارات حضرية تحترم الضوابط البيئية مع مراعاة الاستعمال المتوازن للفضاءات الطبيعية والحضرية والوقاية من التلوث. وتهدف هذه الدراسة الى توضيح الآليات التي يخضع لها التعمير والبناء للموازنة بين الحق في البناء والحق في البيئة، وقد تم تأطيرها من خلال مجموعة من القواعد، أين تتولى وثائق التعمير هذه المهمة كأحد الأدوات القانونية التي تجسد الاستراتيجية الحضرية المعتمدة في الميدان، مع مراعاة الاهتمامات البيئية أثناء إعدادها وتنفيذها. Building rules aim to control and regulate land use processes in their various manifestations, while the environment is the container that contains and is affected by these processes, which requires the development of urban options that respect environmental controls while taking into account the balanced use of natural and urban spaces. Where this study aims to clarify the mechanisms through which reconstruction and construction are subject to the balance between the right to build and the right to the environment, and it has been framed by a set of rules, where the reconstruction documents undertake this task as one of the tools that embody the urban strategy adopted in the field, taking into account the concerns environment during its development and implementation.
