مساهمة الخبرة المحاسبية القضائية في حل المنازعات الضريبية: دراسة حالة بمكتب خبير محاسبي قضائي بولاية البليدة

Résumé: تهدف هذه الدراسة لإبراز دور وأهمية الخبرة المحاسبية القضائية في حل المنازعات الضريبية من خلال تسليط الضوء عن واقع تطبيق الخبرة القضائية في الجزائر، بالإعتماد على المنهج الوصفي والتحليلي، ولإعداد الجانب التطبيقي تم الإستعانة بمختلف الوثائق والمستندات والتقارير والمعلومات المقدمة لنا من طرف الخبير القضائي المحاسبي محل الدراسة المتعلقة بالخبرة التي قام بها هذا الاخير والمطلوبة من قاضي محكمة شرشال في سنة 2018. وتوصلت الدراسة إلى أن المكتب محل الدراسة يطبق الخبرة القضائية في النزاعات الجبائية بصفة كلية، إلا أن هناك بعض الخبرات المطلوبة من القضاة لا تحل لصعوبتها وتعقيداتها، لذلك وجب على المكتب جمع معلومات مناسبة ودقيقة وتحليلها لمساعدته على تحرير تقرير الخبرة وايداعه لدى امانة الضبط وفي الوقت المناسب، لمساعدة القاضي في الفصل في الدعوى الضريبية. This study aims to highlight the role and importance of forensic accounting expertise in tax disputes resolution through highlighting the reality of applying forensic expertise in Algeria, adopting the analytical and descriptive approach, in order to prepare the practical side we used all the documents, reports and information provided to us from the accounting forensic expert under study which is related to the experience carried out upon the request from the Cherchell court judge in 2018. The study concluded that the office under study is preparing special reports of forensic accounting expertise. However, there are some experiences required by judges does not contribute in tax disputes resolution because of its difficulty and complexity, therefore it’s mandatory for expert to collect an appropriate and accurate information and analyzing it to assist in preparing the expertise report and hand it to control secretariat in a timely manner, to support the judge in adjudicating the tax case.
