Résumé: تعتبر فكرة التقاضي عن بعد متميزة في مجال الاجراءات الجزائية تسعى من خلالها الدول إلى مواكبة التطورات التي عرفتها المجتمعات في عصر الرقمنة من جهة، وتكريس المبادئ التقليدية حيث تستدعي المحاكمة العادلة أن تجرى حقوق الانسان عبر مراحل الدعوى الجزائية من جهة ثانية، حيث تستدعي المحاكمة العادلة أن تجرى المحاكمة في جلسات علنية، أين يتمكن الجمهور من حضور جلسات المحاكمة ومتابعة ما يدو ر فيها من مناقشات ومرافعات وما يصدر فيها من أحكام، اعتمادا على النقاش الشفوي والاستماع لأقوال أطراف الدعوى وتصريحاتهم بصوت مسموع أمام هيئة المحكمة وفي حضور الخصوم والجمهور The idea of remote litigation is considered distinct in the field of criminal procedures, through which states seek to keep pace with the developments witnessed by societies in the era of digitalization, on the one hand, and to devote traditional principles.
