المعاملة الضريبية لدخل الملكية العقارية

Résumé: ملخص: يتناول المقال بالبحث المعاملة الضريبية للدخل المتأتي من الملكية العقارية، إذ يكشف التشريع الضريبي في هذا السياق، أن المشرع الجزائري يفرض الضريبة على الدخل الفعلي الذي تُدرَه الملكية العقارية، وينصرف ذلك إلى الإيرادات المحققة من الإيجارات العقارية، فضلا عن تلك المترتبة عن فوائض القيمة الناتجة عن التنازل بمقابل عن العقارات والحقوق العقارية، ويُستشف من النصوص القانونية ذات الصلة، العناية التي أولاها المشرع للضريبة التي تطال الدخل الذي تُدرَه الملكية العقارية، باعتباره من طبيعة دورية و متجدَدة وبحسبانه المعيار الأفضل للتعبير عن المقدرة التكليفية للأشخاص، فقد حدَد المشرع المداخيل العقارية الخاضعة للضريبة ومقدار الضريبة المفروضة عليها والمكلف بدفع الضريبة والتزاماته الجبائية، بما يكفل الحماية اللازمة لحقوق المكلَف ويضمن في الوقت ذاته مستحقات الخزينة العمومية. :Abstract The present article addresses the tax treatment of income derived from real property, in this context, tax legislation reveals that the Algerian legislator imposes tax on the real income generated by real estate. And this extends to the revenues generated from real property rentals, as well as the income resulting from the surplus value from the assignment in exchange for real properties and real estate rights. It can be seen from the relevant legal texts that the legislator paid attention to the tax that affects the income generated by real property, as it is of a periodic and renewable nature and is the best criterion for expressing people’s tax capacity. The legislator has determined taxable real property income, the amount of tax imposed on it, the taxpayer and his tax obligations, in a way that ensures the protection of the taxpayer’s rights and at the same time guarantees the dues of the public treasury.
