الترخيص الإداري المسبق كآلية لممارسة نشاط الصيرفة الإسلامية

Résumé: تهدف هذه الدراسة إلى الوقوف على موضوع الترخيص المسبق لتسويق منتجات الصيرفة الإسلامية في ضوء أحكام التشريع الجزائري، حيث أخضعه المشرع لأحكام خاصة نص عليها النظام رقم 20-02، أوجب من خلاله ضرورة الامتثال لمجموعة من الشروط والإجراءات، والتي يمكن من خلالها للجهة المختصة منح الترخيص المسبق لتسويق منتجات الصيرفة الإسلامية في البنوك والمؤسسات المالية عبر شبابيك الصيرفة الإسلامية. خلصت هذه الدراسة إلى أن آلية الترخيص المسبق ماهي إلا تدبير قانوني ووقائي، تتخذه الجهة المكلفة بالإشراف على النشاط المصرفي، لضمان رقابة مسبقة على كيفية ممارسة نشاط الصيرفة الإسلامية ومختلف العمليات المصرفية المتعلقة به، دون أن يكون ذلك عائقا أمام حرية الاستثمار وممارسة هذا النشاط This study aims to examine the subject of prior licensing for the marketing of Islamic banking products in light of Algerian legislation, the Algerian legislator has subjected it to special provisions under regulation No. 20-02, through which he requires compliance with a set of conditions and procedures so that the competent authority could grant a prior license to market Islamic banking products in banks and financial institutions through Islamic banking windows. The study concluded that the mechanism of prior licensing is a legal and preventive measure taken by the administration responsible for banking activity to ensure prior control over the conduct of Islamic banking and the various banking operations relating to it, without being an obstacle to the freedom of investment, and exercising this activity.
