أساليب مكافحة جرائم الفساد في نطاق القانون الدولي

Résumé: الملخص: بعد أن تحولت جرائم الفساد من جريمة داخلية إلى جريمة عابرة للحدود، أثرت على جميع المستويات، فرضت تحركا دوليا تجسد من خلال الاتفاقيات التي حاولت الإحاطة بتلك الجرائم، والتي كانت اتفاقية الأمم المتحدة لمكافحة الفساد لسنة 2003 مرجعا أساسيا لثمرة تلك الجهود، ومؤثرا رئيسيا في تطوير مستوى مكافحة الدول لهذه الجرائم، وذلك من خلال أساليب التجريم والعقاب التي يفترض التزام الدول بها من جهة، وكذا الأساليب الإجرائية لتجسيد التعاون الدولي كعمليات استرداد الأموال وتسليم المجرمين من جهة أخرى، ولهذا جاءت هذه الدراسة لتحديد مختلف الأساليب الدولية لمكافحة جرائم الفساد، ومدى فاعليتها في الحد من ارتفاع معدلاتها. الكلمات المفتاحية: جرائم الفساد، جهود المكافحة، المنظمات الدولية، الأمم المتحدة، الاتفاقيات. Abstract: After corruption crimes turned from an internal crime to a cross-border crime, it affected all levels, and imposed an international movement , embodied through agreements that attempted to surround corruption crimes, which the United Nations Convention against Corruption in 2003 was a basic reference for the fruit of Those efforts, and a major influence in developing the level of states’ combating these crimes, through the mechanisms of criminalization and punishment that states are supposed to abide by on the one hand, as well as procedural mechanisms to embody international cooperation such as money recovery and extradition on the other hand, and this study came to identify the various international mechanisms To combat corruption crimes, and their effectiveness in curbing their high levels.
