الرقابة الشرعية على الغذاء في الشريعة الاسلامية والقانون الجزائري

Résumé: إن الغذاء من الحاجات الأساسية لعدم فناء البشر كالهواء، ومن أجل الحرص على سلامة هاته المادة؛ سن الدين الحنيف الحسبة أو الرقابة الشرعية غايتها المحافظة على سلامة الغذاء من كل أوجه الغش وهذا لتحقيق المقاصد الكلية للشريعة الاسلامية من حفظ للدين والنفس والعقل والمال والنسل وهذا لا يتأتى إلا بغذاء سليم، بالموازاة لذلك كان للمشرع الجزائري من خلال القانون الوضعي اجتهاداته بإصدار قوانين ومراسيم تعمل على تحقيق الغاية من الرقابة. سنتطرق في هاته الورقة البحثية إلى ماهية الرقابة الشرعية للغذاء، كما نتناول تأصيل الرقابة من الكتاب والسنة والغاية منها، كما نستعرض أهم القوانين الصادرة للرقابة على الغذاء والآليات التي تعمل على تنفيذها Abstract : Food is one of the basic needs so that humans do not perish like air, and in order to ensure the safety of this substance. The enactment of the true religion, hisbah or legal control, aims to preserve the safety of food from all aspects of fraud, and this is to achieve the overall purposes of Islamic law from preserving religion, soul, mind, money and offspring, and this can only be achieved with healthy food. achieve the purpose of oversight. In this paper, we will discuss what is the legal control of food, and we will also discuss the rooting of control from the Book and the Sunnah and its purpose, as well as review the most important laws issued for food control and the mechanisms that work to implement them.
