آليات الرقابة البرلمانية على أعمال السلطة التنفيذية

Résumé: إن رقابة البرلمان على أعمال السلطة التنفيذية يعد نتيجة مباشرة لإقرار المؤسس الدستوري لمبدأ الفصل بين السلطات، الذي يهدف إلى تحقيق التوازن والتعاون بين السلطتين التشريعية والتنفيذية بما يضمن خضوع الهيئات الحاكمة للقواعد الدستورية، غير أنه وبسبب هيمنة السلطة التنفيذية على السلطة التشريعية وأمام تراجع دور البرلمان الرقابي فيهما، فإن دور الرقابة البرلمانية كآلية قانونية لضمان نفاذ القواعد المنصوص عليها بموجب التعديل الدستوري لسنة 2020 من خلال المستجدات التي أضافها ضم الِاستجواب للآليات التي تُرتِب مسؤولية سياسية للحكومة، ورغم ذلك هناك العديد من النقائص في مجال الرقابة كان ينتظر منه معاجلتها في هذا التعديل. The censorship of the legislative power on the facts of the executive power is a direct result for the constitutional founder to establish the principle of the separation of powers which aims to achieve balance and cooperation between the two executive and legislative powers. This ensures the obedience of government agencies to the rules of the constitution. Nevertheless, and because of the supremacy of the legislative power over the executive power in Algeria and Morocco, and in view of the declining role of the censorship of the head of parliament in both countries, the censorship of the parliament as a legal mechanism to ensure the enforcement of the Constitutional Amendment of 2020 especially in its oversight function of government activity.
