رخصة البناء في التشريع الجزائري

Résumé: تطرح مسألة التحضر والتمدن في الجزائر مجموعة من العوائق والإشكالات الواقعية، أبرزها ظاهرة العمران والفوضى التي يعرفها. حيث أولى المشرع الجزائري بعد التعددية أهمية قصوى لهذه المسالة من خلال إصدارة لمجموعة هائلة ومتميزة من التشريعات التي تهدف كلها إلى معالجة الوضع الراهن، وأهمها القانون 90/29 المتعلق بالتهيئة والتعمير كأول قانون يهدف إلى تنظيم المجال العمراني، من خلال مجموعة الآليات التنظيمية الجماعية والفردية التي غايتها تنظيم هذا المجال بصفة عامة والبناء بصفة خاصة بواسطة الرخص والشهادات ومن بينها رخصة البناء والتي خصها بنظام قانوني خاص وفريد من نوعه، بغية تنظيم العمران والبناء. الكلمات المفتاحية: قانون التهيئة والتعمير – المنازعة الإدارية –القضاء العقاري – رخصة البناء –مخالفات رخصة البناء. ABSTRACT: The Issue Of Civilization And Urban Development In Algeria Presents A Set Of Realistic Obstacles And challenges. Most Notably The phenomenon Of Urbanization And The Chaos It Experiences. The Algerian Project. Following Pluralism. Attached Utmost Importance To This Issue Since Its Inception Issuing a Vast And Distinguished Set Of Legislation Aimed At. Addressing The Current Situation. The most Singnifcant Of These Is Law 90/29 Cocerning Planning And Development As The First Law Aimed At Regulating The Urban Sector Through A Range Of Collective And Individual Regulatory Mechanisms. The Purpose Of These Mechanisms Is To Oranize this Sector In General And Construction In Particular Through Licenses And Certificates Including The Building Permit Which Is Governed By A Unique And Specializd Legal System This Is Done In Order To Regulate Urbanization And Construction.
