حماية عمال الشركات التابعة من التسريح لأسباب اقتصادية في ظل تركيز المشاريع

Résumé: يشغل موضوع التسريح لسبب اقتصادي كصورة من صور إنهاء عقد العمل غير محدد المدة في القانون الجزائري والمقارن مكانة مهمة لدى المجتمع بأكمله، وأصحاب العمل والعمال على وجه الخصوص لما له من تأثير كبير على النمو الاقتصادي؛ ذلك بغرض تحقيق التوازن بين الفعالية الاقتصادية والاستقرار الاجتماعي. ومن أبرز الإشكالات التي تطرح على الصعيد العملي في ظل تركيز المشاريع هو مصير عمال الشركة التابعة في حال إذا قررت الشركة الأم تسريحهم بناء على قرار إذا اقتضت مصلحة الوحدة الاقتصادية للمجموعة ذلك. وأمام عدم إفراد المشرع الجزائري عمال الشركة التابعة بأحكام خاصة في حالة التسريح الاقتصادي يتوجب علينا الرجوع إلى القواعد العامة. The issue of dismissal for an economic reason as a form of termination of an indefinite employment contract in Algerian and comparative law occupies an important position in the entire society, and employers and workers in particular, due to its significant impact on economic growth. This is in order to achieve a balance between economic efficiency and social stability. Among the most prominent problems that arise on the practical level in light of the focus of projects is the fate of the subsidiary company's workers in the event that the parent company decides to dismiss them based on a decision if the interest of the group’s economic unit requires. Faced with the failure of the Algerian legislator, the employees of the subsidiary company to have special provisions in the event of economic lay-off, which requires us to refer to the general rules.
