تطبيق إجراء التسليم المراقب لمواجهة جرائم الفساد في ظل الاتفاقية الثنائية (الجزائر- فرنسا)

Résumé: يعتبر التسليم المراقب أسلوب من أساليب التحري الخاصة التي تلجأ إليها الجهات القضائية المختصة لمتابعة الجرائم الخطيرة أهمها جرائم الفساد، ولقد أبرمت اتفاقية التعاون القضائي في المجال الجزائي بين دولة الجزائر وفرنسا لتدعم هذا الإجراء؛ والذي يتم وفق الشروط المنصوص عليها في قانون الإجراءات الجزائية للبلدين، حيث تكمن أهميته في ضبط العائدات الإجرامية المتأتية من جرائم اختلاس الممتلكات والرشوة وغيرها من صور الفساد التي ارتكبها كبار المسؤولين ورجال الأعمال في الجزائر. Controlled delivery is one of the special investigative methods used by the competent judicial authorities to follow up on serious crimes, the most important of which are corruption crimes. An agreement on judicial cooperation in the criminal field was concluded between the State of Algeria and France to support this procedure. Which takes place in accordance with the conditions stipulated in the Code of Criminal Procedures of the two countries, as its importance lies in seizing criminal proceeds derived from crimes of embezzlement of property, bribery and other forms of corruption committed by senior officials and businessmen in Algeria.
