الدفع بوجود اتفاق التحكيم في المنازعات العمالية

Résumé: للتحكيم ميزة خاصة، إذ يساعد على فضّ المنازعات بطريقة ودية وسهلة تحافظ على بقاء العلاقة بين طرفي التحكيم، ويُعدُّ التحكيم الوسيلة الأسرع في فض المنازعات بشكل عام، حيث يعرف بأنه القضاء الخاص الذي يلجأ إليه أطراف النزاع بإرادتهم الحرة من أجل حل المنازعات بطريقة ودية . وللتحكيم في القضايا العمالية أهمية كبرى؛ حيث إن طبيعة قواعد قانون العمل تتسم بالطبيعة الآمرة التي لا يجوز للأفراد الاتفاق على مخالفتها لتعلقها بالنظام العام، ولكن ليست الآمرة المطلقة؛ إذ يجوز مخالفتها إذا كان لذلك مصلحة أفضل للعامل، ويناقش البحث مدى إمكانية اللجوء للتحكيم من قبل أصحاب العمل والعمال رغم الطبيعة الآمرة.
