تــــــــــغيــــــــــــــــــــــير الألقــــــــــــــــــــاب المشيــــــــــــــنة للأطفــــــــــــــــــــــــــــــــــــــال The Change Of Bad Cognomen Of Children

Résumé: لقد تم تأسيس نظام الألقاب العائلية في الجزائر بموجب قانون الحالة المدنية الذي أقرته سلطات الاحتلال الفرنسي بتاريخ 23 مارس 1882، والعديد من هذه الألقاب التي تم إقرارها بموجب هذا القانون يحمل معاني ودلالات مشينة و نابية. تنتقل الألقاب المشينة من الآباء إلى الأبناء، ولتصحيح هذا الوضع تم إصدار المرسوم التنفيذي رقم 71-157 المؤرخ في03/06/ 1971م الذي يُـــبين إجراءات تغيير الألقاب، إلا أن الكثير من الآباء الجزائريين عزفوا عن تغييرها، فنشأ أطفالهم وهم محاطون بالكثير من السخرية والتهكم ممن حولهم، ولو عن غير قصد، بسبب هذه الألقاب المشينة، مما أثر سلبا على تحصيلهم العلمي واستقرارهم النفسي، في ظل عدم قدرتهم على تغييرها بأنفسهم، باعتبارهم إما ناقصي أو عديمي الأهلية، مما يوجب تدخل البرلمان لكي يضع تشريعاً يلزم استبدال الألقاب المشينة بأخرى حسنة تقوم مقامها، ليجسد فعلا حق الأطفال في أن يحملوا لقبا حسنا يعرفون به، يسمح لهم بأن يعيشوا حياة طبيعية. The foundation of cognomen sustem in Algeria , was according the civil status law which was put by the French occupation authorities of 23 ed Marsh,1882,and many of these familynames have had and disgrace meanings. These bad cognomen move from parents to their children although the emergence of the executive decree № 71-157 of 03/ 06 /1971, shows the procedures of change family names. But the majority of Algerian parents hadn’t done that change so,their children had grew up surrounded by a lot of iromy and cynicism, either conscionsly or not because of these bad family names , which leads to a neagative effect on their educational and psychological stability, because they 're incapable of changinge their family names themselves . For this raison parlimant must impose a legislation which emphasize on change of had names by well ,and suitable ,ones which really emplody children s'rights in carruyin a well names that lead to a normal life .
