جرائم المساس بانظمة المعالجة الألية للمعطيات في التشريع الجزائري

Résumé: تعد جرائم المساس بانظمة المعالجة الآلية للمعطيات من الجرائم المستحدثة والمتميزة عن مختلف اشكال الجرائم الكلاسيكية وهذا من خلال طبيعتها وموضوعها وخصائصها وتشمل جرائم المساس بانظمة المعالجة الآلية للمعطيات في التشريع الجزائري جريمتي الدخول والبقاء غير المشروع للنظام المعلوماتي ، وجريمة الغش المعلوماتي وكذا جريمة اتلاف النظام الالي ولقد حاول المشرع الجزائري مواجهة هذه الجرائم مواكبا في ذلك مختلف التشربعات الحديثة من خلال تعديل قانون العقوبات وفق القانون 04-15 الذي إستحدث بعض الجرائم ضمن القسم السابع منه المعنون ب"المساس بأنظمة المعالجة الآلية للمعطيات ." فماهي السياسة التي انتهجها المشرع لمكافحة هذا النوع من الجرائم وهل نجح في الحد منها ؟ ولقد خصصنا هذه الدراسة لتسليط الضوء على تعريف هذه الانواع من الجرائم وتحديد اركانها وكذا العقوبة المقررة بشانها The world is witnessing a huge and rapid development in the world communications technology, so that the modern means of communication, especially the Internet, become an indispensable means, and an engine of the new civilization, on which the idea of communication not transition is based, and this network is one of the results of integration between the revolution of information and communication technology ; This network, which was developed at a tremendous speed has been able to remove the borders and distances between countries and make the world a small village, but this technology has brought with negative effects of crimes called crimes against digital data, so, in the chapter , we discussed the definition of digital data as: digital or non-numeric facts that are carried out in a systematic manner whose significance can be understood directly without engaging in extrapolative inductive processes for their complex evidence through more than one statement.
