التعايش بين المذهبين المالكي والحنفي في الجزائر العثمانية في مجال الافتاء

Résumé: تسعى هذه الدراسة لإثبات مسألة تعايش المذهبين المالكي والحنفي في الجزائر خلال العهد العثماني(1518ـــ1830)، فبعد أن أصبحت البلد إيالة عثمانية؛ كان من الضروري عودة المذهب الحنفي إليها بعد قرون من الاندثار، و بالرغم من الاختلاف في خصائص المذهبين، إلا أن المذهب الحنفي كان مصدرا للتنوع المذهبي، والثراء الفقهي، فظهرت روح الأخوة و التسامح بين أتباع المذهبين في جميع المجالات؛ و لعل من أبرزها جانب الإفتاء حيث كان الحنفي يستفتي المالكي والعكس صحيح، كما عمل علماء المذهبين جنبا إلى جنب في المجالس المشتركة، كالمجلس العلمي، ومجلس الباشا، وتطرقوا للنوازل المختلفة، فاختلفوا في بعضها، وتوافقوا في بعضها الأخر، كما تولى جزائريون خطة الافتاء على المذهب الحنفي ولم يجدوا في ذلك حرجا، وفي هذا دلالة على وجود قابلية عند الفرد الجزائري للتعايش والتسامح ، ونبذ التعصب وتجاوز الخلافات. This study deals with the subject of the coexistence between the Maliki and Hanafi school in Algeria during the Ottoman period (1518-1830), after the country became an Ottoman stat , It was necessary for the the Hanafi school to return to it after centuries of extinction , despite the difference in the characteristics of the two schools, the hanafi school was a source of religious diversity, jurisprudential wealth, a spirit of brotherhood and tolerance emerged between the followers of the two sects in all fields, especially in the field of justice and advisory opinions. As well as in the field of education, which brought together teachers and academics from hanafi and maliki jurisprudence. In addition, the relations of cooperation and coordination between the two doctrines in many general issues related to Algerian society.
