الرقابة القانونية على أشغال التعمير
Résumé: تعتبر عقود التعمير وسائل قانونية إدارية تجسد دور الدولة الحارسة، و ذلك بتقييد حرية الأفراد بإتخاذ إجراءات وقائية لازمة تمثلت في رخص و شهادات التهيئة و التعمير. حيث تعتبر أدوات قانونية هامة لرقابة الأشغال ماقبل البناء و مابعد البناء و التوسع العمراني، حيث لا تمنحها الإدارة إلا اذا توافرت الشروط و الإجراءات القانونية المنصوص عليها في قوانين التهيئة و التعمير. Reconstruction contracts are considered legal and administrative means that embody the role of the guardian state, by restricting the freedom of individuals to take necessary preventive measures represented in the licenses and certificates of preparation and reconstruction. As they are considered important legal tools to control pre-construction, post-construction, and urban works, as the administration does not grant them unless the conditions and legal procedures stipulated in the planning and reconstruction laws are met.
