المحكمة الدستورية والسلطة التشريعية، أي علاقة؟

Résumé: الملخص باللغة العربية: إذا كانت صلاحية التشريع تشكل اختصاص أصيل للبرلمان، وكانت المحكمة الدستورية في بتها في دستورية القوانين قد تجعلها بمثابة من يلقن دروساً لهذا الأخير في صلب صلاحياته ، وإذا كانت بتدخلها في عضوية المجالس المنتخبة البرلمانية كقاضي انتخابات من جهة وسلطة تتولى رقابة دستورية القانون العضوي للانتخابات والنظام الداخلي لغرفتي البرلمان من جهة أخرى، تطرح اشكالية تحكم المحكمة الدستورية غير المباشر في السلطة التشريعية عضويا ووظيفيا. تهدف هذه الورقة البحثية الى ابراز العلاقة بين المحكمة الدستورية والبرلمان -هل هي علاقة تعاون أو تدخل غير مبرر؟-، خاصة في ظل صدور النظام المحدد لقواعد المحكمة الدستورية في 22 جانفي 2023 وما صحبه من مستجدات في هذا المجال. Abstract: If the power of legislation constitutes an inherent prerogative of Parliament, and the Constitutional Court's determination of the constitutionality of laws may make it the subject of lessons for the latter at the heart of its powers, If it interferes with the membership of the parliamentary elected assemblies as an electoral judge on the one hand and has the authority to monitor the constitutionality of the organic law of the elections and the rules of procedure of the chambers of parliament on the other legislative power ", poses a problem that governs the indirect Constitutional Court in the legislative branch both organically and functionally. This paper aims to highlight the relationship between the Constitutional Court and Parliament. In particular, the Constitutional Court's rules of procedure were promulgated on 22 January 2023 and accompanied by developments in this area.
