المحكمة الإدارية الإستئنافية بالجزائر

Résumé: في عام 2020، أعلن المؤسس الدستوري عن تأسيس محاكم إدارية للاستئناف، وتبع هذا الإعلان صدور القانون المتعلق بالتقسيم القضائي والتنظيم القضائي، ثم تعديل قانون الإجراءات المدنية والإدارية في عام 2022. وبهذا، تم استكمال بناء نظام القضاء الإداري في الجزائر الذي تم الإعلان عنه في التعديل الدستوري لعام 1996. دخل القضاء الإداري مرحلة جديدة مع إنشاء المحاكم الإدارية للاستئناف كدرجة ثانية للتقاضي في القضايا الإدارية. أصبح النظام القضائي الإداري يضم الآن مجلس الدولة، والمحاكم الإدارية للاستئناف، والمحاكم الإدارية، مما يجسد مبدأ التقاضي على درجتين الذي يكفل للمتقاضين العدالة، ويعيد الاعتبار للدور الأساسي لمجلس الدولة. تهدف هذه الدراسة إلى فهم النظام القانوني للمحاكم الإدارية للاستئناف وتبيان الآثار القانونية الناجمة عن إنشائها. In 2020, the constitutional founder announced the establishment of Administrative Courts of Appeal. This announcement was followed by the issuance of the law related to judicial division and judicial organization, and then by the amendment of the Civil and Administrative Procedure Code in 2022. Thus, the construction of the administrative judiciary system in Algeria, which was announced in the constitutional amendment of 1996, was completed. The administrative judiciary entered a new phase with the establishment of Administrative Courts of Appeal as a second instance for adjudicating administrative matters. The administrative judicial system now includes the Council of State, Administrative Courts of Appeal, and Administrative Courts, embodying the principle of two levels of litigation, which guarantees justice for litigants and restores the original role of the Council of State. This study aims to understand the legal system of the Administrative Courts of Appeal and to elucidate the legal effects resulting from their establishment.
