إستعمال اللغة العربية في صياغة القواعد القانونية في الجزائر

Résumé: الملخص: تعتبر الصياغة القانونية الوسيلة المباشرة التي يتم من خلالها اِنشاء النصوص القانونية وإظهارها إلى الحيز الخارجي لتكون قابلة للتطبيق العملي من طرف المخاطبين بها، فهي تعمل على أخذ المعطيات القانونية التي تعد جوهر القاعدة القانونية وإنشائها في قوالب من ألفاظ ومصطلحات قانونية تشكل بنية القاعدة القانونية وفق معايير معينة يساهم كل منها في اِضفاء خاصية معينة على القاعدة القانونية. ولكون غالبية المخاطبين بالقواعد القانونية وفي مختلف المجالات هم أشخاص غير متخصصين في مادة القانون، ولضمان تحقيق التوازن الإجتماعي، فإنه ينبغي على المشرع الوطني أن يكون ملما باللغة القانونية وألفاظها حتى يكون قادرا على اِيصال المعنى الذي يريد الوصول إليه، لذا هو مُطالَب بصياغة القواعد القانونية بلغة بسيطة قريبة ومألوفة من لغة تخاطب الرجل العادي غير المتخصص في القانون، وهو أمر لا يتحقق إلا بمراعاة اللغة الرسمية في صياغة القواعد القانونية. Abstract: through which legal texts are created and shown to the outside world to be applicable to those who address them. Legal drafting works to take the legal data that is the essence of the legal rule and create it in templates of legal terms that form the structure of the legal rule according to certain standards, each of them contributes to imparting a specific characteristic to the legal rule. And since the majority of people to whom the legal rules and the various fields are addressed are people who are not specialized in the subject of law, and to ensure the achievement of social balance, the national legislator must be familiar with the legal language and its expressions in order to be able to convey the meaning he wants to reach, so he is required to formulate legal rules in a simple language, close and familiar to the man in the street who is not specialized in law, something that can only be achieved by observing the official language in the formulation of legal rules
