الحماية القانونية للطفل اللاجئ في المواثيق الدولية و القانون الجزائري

Résumé: ملخص: تهدف هذه الدراسة إلى إبراز مظاهر الحماية التي تكفلها المواثيق الدولية و القانون الجزائري للأطفال اللاجئين من كل أشكال العنف التي يمكن أن يتعرضوا له، حيث تمحورت الإشكالية المطروحة حول مدى كفاية الحماية المقررة للطفل اللاجئ في المواثيق الدولية و القانون الجزائري؟ خلصت الدراسة إلى انه بالرغم من إقرار حماية خاصة للأطفال اللاجئين بموجب الاتفاقيات الدولية من جهة ،و النص على حمايتهم من طرف المشرع الجزائري بصفة صريحة لأول مرة بموجب القانون 15/12،إلا أن قواعد الحماية هذه تحتاج لتطبيقها إلى تضافر الجهود بين الدولة المضيفة من جهة و المجتمع الدولي ككل. Abstract: This study aims at highlighting the manifestations of the protection guaranteed by international conventions and the Algerian Law for the refugee children, from all kinds of violence that they can face. The problematic raised is about the extent of sufficiency of the protection recognized for the refugee child in the international conventions and the Algerian law. The study concluded that, in spite of recognizing a special protection for the refugee children, in accordance with the international conventions, and the stipulation of their protection by the Algerian legislator explicitly, for the first time, under law No. 15/12, these protection regulations, to be applied, requires concerted efforts among the host country, and the international community as a whole.
