دور آليات الحوكمة في تفعيل أداء شركات التأمين التكافلي

Résumé: يكتنف نشاط شركات التأمين التكافلي العديد من المخاطر، ولعل أهم هذه المخاطر عدم قدرتها على الوفاء بالتزاماتها تجاه دائنيها، مما يعني إفلاسها وخروجها من السوق، الأمر الذي يتطلب منها اتخاذ التدابير والإجراءات الملائمة لإدارة وضبط هذه المخاطر وفق أفضل الممارسات الدولية، وبغرض تفعيل أداء شركات التأمين التكافلي قام مجلس الخدمات المالية الإسلامية بماليزيا بإصدار العديد من المعايير الشرعية التي تسعى لنشر دعائم الشفافية والإفصاح في المؤسسات المالية الإسلامية، وترسخ معنى الحوكمة. وعليه سنركز من خلال هذه الدراسة على دور تطبيق مبادئ الحوكمة في تفعيل أداء شركات التأمين التكافلي، نظراً لما تكتسيه من أهمية في تنمية قطاع التأمين التكافلي، وتخفيض درجة المخاطرة المتعلقة بالفساد الإداري والمالي على مستوى هذه الشركات Cooperative insurance companies in general and Islamic cooperative insurance companies as well are exposed to a variety of risks as a result of the development of international-economic and financial relations. Corporate Governance is essentially a system used by the management to direct and control the activities of the Company by ensuring integrity, transparency and honesty in managing the affairs rather than looking upon the same as a legally imposed obligation. Corporate Governance inspires and enhances the confidence of shareholders and strengthens their affiliation to the Company. The challenge will be to develop an enabling environment through the provision of a legal regulatory and supervisory and Shariah framework to support the sound and efficient growth and development of the Islamic insurance industry. This study focuses on the role of each corporate governance policies and the good policies of Islamic Financial Services Board (IFSB) to give the takaful industry more access to the financial markets, result in better performance and company valuations and allow operators to further develop the market.
