جريمة السرقة المعلوماتية

Résumé: تهدف هذه الدراسة للتعرف على ماهية جريمة السرقة المعلوماتية، من حيث مفهومها واركانها، ومدى انطباق النصوص التقليدية في التشريع الأردني عليها، إضافة الى التعرف على اهم خصائص جريمة السرقة المعلوماتية ومدى انطباق فعل الاختلاس على المال المعلوماتي بعد التعرف على مدى انطباق وصف المال على معلومات وبرمجيات الحاسب الالي. وقد توصل الباحثون الى عدم انطباق النص التقليدي للسرقة على البيانات والبرامج والمعلومات الالكترونية الا إذا كانت مفرغة على دعامة. This study aims to identify the nature of the crime of information theft, in terms of its concept and pillars, and the extent to which the traditional texts in Jordanian legislation apply to it, in addition to identifying the most important characteristics of the crime of information theft and the extent of the applicability of the act of embezzlement to information money after identifying the extent to which the description of money applies to information and software computer. The researchers concluded that the traditional text of theft does not apply to data, programs and electronic information unless it is hollowed out on a pillar.
