Résumé: الملخص باللغة العربية: تهدفُ هذه الدراسة إلى إبراز النَّزعة الحديثية عند الفقيه المالكي محمد بن عبد السلام التُّونسي في نقده لفروع الفقه المالكي، من خلال كتابه تنبيه الطالب لفهم ألفاظ جامع الأمهات لابن الحاجب، وقد تبين من خلال ما أورده في شرحه هذا أنَّ له منهجاً ينحو به منحى أهل الحديث في نقده لفروع المذهب، بشهادة صيغه اللَّفظية الدالة على ذلك، وبناءً على أهم المرتكزات النَّقدية الصريحة في الباب، مثل: نص إمام المذهب أنَّ الحديث لم يبلغه، وشهادة أهل الشأن بصحة الحديث، وقد ظهر من خلال المسائل التطبيقية في باب الصلوات الجامعة ما يؤكد هذه النَّزعة، ممَّا يؤهل طريقته لئن تكون نموذجاً يحتذى به في التَّعامل مع مسائل الخلاف المذهبي، لمن اشتدَّ عوده في العلم، وبلغ أشدَّه في الفهم، وكل ذا ممَّا يبعدُ شبهة الجمود على نصوص المذهب. The article summary is in English: This study aims to highlight the hadith tendency of the jurist Muhammad bin Abd al-Salam al-Tunisi in criticizing the branches of Maliki jurisprudence through his book Alerting the student to understand the words of the al-Ummah Mosque by Ibn al-Hajeb, as he comprehended and criticized a number of the sayings contained in his explanation, and it was found through what he reported that he had a method The attitude of the owners of the modern tendency, selection and weighting among the branches of the doctrine, but his criticism went beyond the well-known doctrine, and the most famous of what he relied on in his criticism is a rule: the text of the Imam of the doctrine that the hadith did not reach him, and a rule: the testimony of the people concerned with the authenticity of the hadith, and this was demonstrated through the selected applied issues One of the issues of collective prayers is the firmness of his monetary possession, which qualifies his method to be a model to be followed in dealing with matters of doctrinal dispute, and all of this increases the freshness of Maliki jurisprudence, and removes the suspicion of stagnation in the texts of the doctrine.
