تجريم ممارسات التقليد في ظل مبدأ نزاهة الممارسات التجارية على ضوء القانون 04-02 المعدل والمتمم

Résumé: تعتبر ممارسات التقليد من أخطر الممارسات التجارية غير النزيهة التي تمثل اعتداء على مصالح العون الاقتصادي المنافس، و على أمن و سلامة المستهلك و مصالحه الاقتصادية في الوقت ذاته، بوصفها أحد صور المنافسة غير النزيهة، التي يترتب عنها جذب و كسب زبائن العون الاقتصادي المنافس من المستهلكين، من خلال زرع الشكوك و الأوهام التي من شأنها إثارة اللبس و الخلط في ذهنهم بغية تضليلهم. و لمكافحة هذه الممارسات غير النزيهة لاسيما في ظل في انتشارها المتزايد، سعى المشرع الجزائري بموجب القانون 04-02 المحدد للقواعد المطبقة على الممارسات التجارية المعدل والمتمم التصدي لآثارها السلبية، و من خلال حظره لصور مختلفة لممارسات التقليد، تشمل كل من تقليد العلامات المميزة للعون الاقتصادي المنافس و تقليد منتوجاته أو خدماته و كذلك إشهاره التجاري. Abstract: Imitation practices are considered among the most dangerous and unfair commercial practices that represent an attack on the interests of the competing economic aid, and on the security and safety of the consumer and his economic interests at the same time, as one of the forms of unfair competition, which results in attracting and winning customers of competing economic aid from consumers by planting doubts and illusions that would stir up confusion and admixture in their minds, leading to their misinformation. To combat these unfair practices, particularly in light of its increasing prevalence, the Algerian legislator sought under Law 04-02 which specifies the rules applicable to commercial practices, to address the negative effects, by prohibiting various forms of imitation practices, including both the imitation of distinctive hallmarks of competing economic aid and imitating its products or services, as well as commercial advertising.
