"تدخّل المحكمة الجنائية الدولية لحماية الأقليات المسلمة : بين النصوص النظرية و الممارسة الفعلية"

Résumé: تعيش الاقليات المسلمة في دول العالم تحت وطأة الظلم و الاستبداد من قبل الاغلبية و حتى من طرف الانظمة الحاكمة ، ما يجعل الحالة التي آلت اليها هذه الأقليات قضية مطروحة و بشدة على الساحة الدولية ، ما يدفع الى البحث عن الآليات و الميكانزمات الموجودة للدفاع عن حقوقها المهضومة . و باعتبار الجزاء الجنائي هو أردع وسيلة لاسترجاع تلك الحقوق ، فقد بات تدخل القضاء الجنائي ضرورة ملحة، و من هنا تبرز أهمية و دور المحكمة الجنائية الدولية باعتبارها آلية قضائية لحماية الأقليات ، من خلال تفعيل النصوص التجريمية الواردة في نظامها الأساسي ، و المتعلقة أساسا بالإبادة الجماعية و الجرائم ضد الانسانية لمتابعة الانتهاكات الممارسة ضد الأقليات المسلمة، و هو ما تم فعلا من خلال مباشرة التحقيق في قضية الروهينجيا . Muslim minorities in the countries of the world live under the weight of injustice and tyranny by the majority and even by the ruling regimes, which makes the situation that these minorities have reached an issue that is strongly raised in the international arena, which prompts a search for the existing mechanisms and mechanisms to defend their oppressed rights . As the criminal penalty is the most deterrent means to restore those rights, the intervention of the criminal judiciary has become an urgent necessity, and hence the importance and role of the International Criminal Court as a judicial mechanism for protecting minorities by activating the criminal provisions contained in its statute to follow up on violations against Muslim minorities.
