مكانة القانون الدولي في النظام الأساسي للمحكمة الجنائية الدولية

Résumé: إن القواعد المطبقة أمام المحكمة الجنائية الدولية هي نتاج فسيفسائي قانوني وبتشكيلة متميزة، وإن تحقيق النتائج العليا في النظام الجنائي الدولي بمزج نماذج تطبيقها للقانون الوطني والقانون الدولي يؤكد التطور الحاصل من نظام تقليدي في تطبيق القانون الجنائي الدولي أمام المحكمة الجنائية الدولية نحو نظام متكامل. وعليه يحتل القانون الدولي مكانة متميزة في النظام الاساسي للمحكمة الجنائية الدولية لما كرسه من ضوابط، واحتضنه من مبادئ، تشعبت مصادره، واتجاهه نحو تحقيق مطلب الاثراء المتبادل للقانون، وتذليله للنزاعات حول مدى تطبيق وتفسير القاعدة القانونية الدولية محل الخلاف أمامه، وصولا إلى ضرورة تفعيل القواعد وتنميتها وتطويرها وأنسنتها. The rules applied before the International Criminal Court are the product of a legal mosaic with a distinct assortment, and the achievement of higher results in the international criminal system by blending their application models for national law and international law confirms the development that has taken place from a traditional system in the application of international criminal law before the International Criminal Court towards an integrated system. Accordingly, international law occupies a distinguished position in the Statute of the International Criminal Court because of the controls it has established and its principles embraced, its sources are diffuse, and its tendency towards achieving the demand for mutual enrichment of law, and its overcoming of disputes over the extent of application and interpretation of the international legal rule in dispute before it, leading to the necessity of activating the rules its development, development and humanization.
