الحماية القانونية للمصنفات الناشئة عن برامج الذكاء الإصطناعي

Résumé: تم في هذه الدراسة بحث موضوع الحماية القانونية للمصنفات الناشئة عن برامج الذكاء الإصطناعي، وذلك من خلال استعراض القواعد العامة لحقوق المؤلف في التشريعات النافذة في فلسطين، بالإضافة لبعض التشريعات المقارنة والإتفاقيات الدولية كإتفاقية بيرن. فتم بدايةً إيضاح المقصود بالذكاء الإصطناعي وامكانية منح برامج الذكاء الإصطناعي الشخصية القانونية، بعدها تم بحث امكانية اعتبار المصنفات الناشئة عن برامج الذكاء الإصطناعي مصنفات محمية بموجب القانون من عدمه، ومدى امكانية انطباق صفة المؤلف على برامج الذكاء الإصطناعي ولمن تعود الحقوق المترتبة على المصنفات الإبداعية الناشئة عن برامج الذكاء الإصطناعي. وتم التوصل في نهاية الدراسة لصعوبة انطباق الشخصية القانونية على برامج الذكاء الإصطناعي، الأمر الذي يستتبعه عدم امكانية انطباق صفة المؤلف على هذه البرامج، فيكون تبعاً لذلك ملكية المصنفات الإبداعية لمن أدت أفعاله وتصرفاته لإخراج المصنف الإبداعي بصورته النهائية للعالم الخارجي. In this study, the issue of legal protection of works produced by artificial intelligence programs was discussed, through a review of the general rules of copyright in the legislation in force in Palestine, in addition to some comparative legislation and international conventions such as the Berne Convention. At the beginning, what is meant by artificial intelligence and the possibility of granting artificial intelligence programs legal personality was discussed, then the possibility of considering works arising from artificial intelligence programs as works protected by law or not, and the possibility of applying the author's status to artificial intelligence programs and to whom the rights resulting from creative works arising from artificial intelligence programs belong. At the end of the study, it was found that the legal personality applies to artificial intelligence programs, Which entails that artificial intelligence programs cannot be expressed as an author, so the ownership of the creative works produced by artificial intelligence programs belongs to those whose actions directly led to the production of the work in its final form.
