تقديم البصمة الوراثية في اثبات النسب أو نفيه على اللعان بين الحظر والجواز. -دراسة فقهية وقضائية مقارنة-ض

Résumé: الملخص: ثار جدل فقهي وقضائي حول مسألة اعتماد البصمة الوراثية كدليل قاطع لإثبات النسب أو نفيه، اذ يرى فريق من الباحثين المعاصرين أن البصمة قد تحل محل اللعان ، وتغني عن استعمال أدلة ثبوت النسب الأخرى (كالفراش،القيافة،الاقرار،البينة،حكم القضاء). أما الفريق الاخر فيرى عدم جواز تقديم البصمة الوراثية على اللعان في نفي النسب اعمالا بقوله (ص) " الولد للفراش" وهو دليل متفق عليه اجماعا ولا يقوى عليه الا اللعان. لقد جاءت هذه الاشكالية لتجيب على عدة تساؤلات منها: هل يجوز شرعا احلال البصمة الوراثية محل اللعان في نفى النسب؟ وهل ينتفي النسب بالبصمة دون اللعان ما دام أن نتائجها تمثل 99.9% وتقترب أكثر الى اليقين منه الى الشك ؟ أم لا بد من اللعان في كل الحالات ؟. تهدف هذه الدراسة الى مناقشة اشكالية استخدام البصمة الوراثية في مجال نفى النسب وطبيعة علاقتها باللعان. منهج هذه الدراسة هو استقرائي –تحليلي مقارن – وذلك من خلال الرجوع الى المصادر الفقهية والدراسات العلمية الحديثة والى أحكام القضاء المعاصر حول موضوع البصمة الوراثية وحجيتها ودورها في اثبات ونفي الأنساب. الكلمات الدالة: النسب-البصمة الوراثية-اللعان- الولد للفراش. اثبات-نفي. Summary: A panel of contemporary researchers has argued that the fingerprint may substitute for leniency and dispense with the use of other proofs of evidence (such as parsing, citation, acknowledgment, evidence, judgment). As for the other team, it is not permissible to present the DNA on the lans in denying the descent by saying "The child of the bed" is a consensus agreed unanimously and can not be strengthened only by tenderness. This problem came to answer several questions, including: Is it permissible to legally replace the DNA in place of denial of descent? Does the percentage of the fingerprint disappear without tenderness as long as the results represent 99.9% and closer to certainty than to doubt? Or is it necessary to shine in all cases? The purpose of this study is to discuss the problematic use of DNA in the field of genealogy and the nature of its relation to the disease. The approach of this study is inductive - comparative analysis - through reference to the sources of jurisprudence and modern scientific studies and to the provisions of contemporary jurisprudence on the subject of DNA and its shield and its role in proving and denying genealogies.
