الجماعات الاقليمية ودورها في تسيير المدن الجديدة في الجزائر ( دراسة تحليلية في القانون 02_08)

Résumé: الملخص: تتناول هذه الورقة البحثية دراسة تحليلية في القانون 02_08 المتعلق بشروط إنشاء المدن الجديدة في الجزائر، وذلك من خلال توضيح صلاحيات الجماعات الاقليمية في تسيير المدن الجديدة ، حيث تهدف هذه الدراسة إلى التعرف على أنماط المدن الجديدة في الجزائر وطرق توزيعها، وتحليل أهم النصوص القانونية التي توضح مختلف الهيئات المكلفة بتسييرها، خاصة وأن هناك العديد من الهياكل المعنية بالأمر حسب ما نصت عليه مختلف التشريعات المتعلقة بالمدن، وهذا في ظل تنوع أنماط المدن الجديدة في الجزائر الى نوعين من المدن الجديدة مدن جديدة مؤطرة قانونا ومدن جديدة غير مؤطرة قانونا. وفي الأخير خلصت هذه الدراسة إلى نتيجة مفادها أن هناك عدة جهات مسؤولة عن تسيير المدن الجديدة حسب التشريعات الجزائرية، غير أن الجماعات الاقليمية تحظى بصلاحيات استشارية فقط، حيث تتولى بصفة أخص تسيير المدن الجديدة التابعة للمدن الرئيسية باعتبار هذه الأخيرة لا تحظى بأي نص قانوني يوضح الهيئة المكلفة بتسييرها. : Abstract This research deals with an analytical study in law 02_08 related to the conditions of the establishment of new cities, by highlighting the role of regional groups in the management of new cities. this study aims to identify the patterns of new cities, the methods of their distribution, and the analysis of the legal texts that explain the various bodies to run them. likewise, in the presence of the diversity of the patterns of new cities in Algeria. new cities that are legally framed and others which are not legally framed. Finally, there are several authorities responsible for managing the new cities according to the legal texts of the cities. However, the regional groups have limited advisory powers regarding the management of new cities affiliated with the main cities, as they do not have legal text that explains the mechanism of their management.
