النظام القانوني للإدارة الرشيدة و التسيير المستدام للنفايات الطبية في الجزائر

Résumé: ملخّص: تعتبر النفايات الناجمة عن النشاطات العلاجية من أخطر أنواع النفايات،نظرا لانعكاساتها المتعددة على البيئة بوجه عام وعلى صحة الإنسان بوجه خاص،لهذا كان لزاماً على المشرع الجزائري أن يتدخّل بالتنظيم والتوجيه لهذه المسألة بهدف ضمان تجسيد ما يصطلح عليه بالإدارة الرشيدة و بالتالي التسيير المستدام للنفايات الطبية،وهو الأمر الذي سعى إلى تجسيده من خلال القانون رقم 01/19 المؤرخ في 12 ديسمبر 2001 المتعلق بتسيير النفايات و مراقبتها و إزالتها ،وكذا النصوص التطبيقية المنظمة له،و في مقدمتها المرسوم التنفيذي رقم 03/478 المؤرخ في 09 ديسمبر 2003 الذي يحدد كيفيات تسيير نفايات النشاطات العلاجية. إنني من خلال دراستي هذه سأحاول معالجة الإشكالية التالية:هل الآليات التي أوجدها المشرع الجزائري بهدف ضمان الإدارة الرشيدة والتسيير المستدام للنفايات الطبية،هي آليات كفيلة بتحقيق الأهداف المرجوة منها،أم أنها قاصرة في بلوغ ذلك ؟ الكلمات المفتاحية:النفايات الطبية،نشاطات علاجية،النفايات . Abstract: Waste from remedial activities is considered one of the most dangerous types of waste because of its multiple impacts on the environment in general and on human health in particular. Therefore, the Algerian legislator has to intervene in organizing and directing this issue in order to ensure the realization of what is called good management and thus the sustainable management of medical waste. , Which was sought to be reflected through Law No. 01/19 of December 12, 2001 on the management, control and removal of waste, as well as the texts of the application of the organization, foremost of which is Executive Decree No. 03/478 of 09 December 2003, which defines how Management Therapeutic activities suspicious deaths. Through this study, I will try to address the following problem: Are the mechanisms created by the Algerian legislator to ensure the rational management and sustainable management of medical waste are mechanisms to achieve the desired goals, or are they inadequate to achieve this?
