آليات الضبط الإداري لحماية البيئة من الأخطار المنجمية

Résumé: تتوفر الجزائر على بنية جيولوجية متنوعة جعلتها تحظى بعدة ثروات معدنية، ومنه أصبح القطاع المنجمي يلعب دوراً مهماً في الاقتصاد الوطني، لكن هذا القطاع قد يتسبّب في المقابل، بتدهور بيئي، الأمر الذي يتطلب تأسيس منظومة قانونية تحدّد الجوانب التي يجب مراعاتها من أجل تحقيق توازن بين الاستثمار ومتطلبات المحافظة على البيئة. وعليه سنركّز من خلال هذا المقال على دور الضبط الإداري في مجال حماية البيئة من الأخطار المنجمية، باعتبار أن الضبط الإداري في مجال حماية البيئة يعدّ كأحد أهم الأنشطة التي تقوم بها الإدارة العامة في سعيها إلى تحقيق التوازن بين الاستثمار في القطاع المنجمي (متطلبات التنمية) ومقتضيات حماية البيئة، وذلك من خلال توفير آليات تقنية جمعت بين الوقاية والرقابة المسبقة قصد ضبط المخاطر والأضرار التي قد تسبّبها الأنشطة المنجمية، والتي قد تهدّد أو تمس بالبيئة. Abstract: Algeria possesses a diverse geological structure that has endowed it with several mineral resources, leading to the mining sector playing a crucial role in the national economy. However, this sector can also cause environmental degradation, necessitating the establishment of a legal framework that specifies the aspects to be considered in order to achieve a balance between investment and environmental preservation. Therefore, this article focuses on the role of administrative regulation in protecting the environment from mining hazards. Environmental regulation, as one of the most important activities carried out by the public administration, seeks to balance investment in the mining sector (development requirements) with the demands of environmental protection. This is achieved through the provision of technical mechanisms that combine preventive and preemptive control to regulate the risks and damages that mining activities may cause, which could threaten or impact the environment.
