الإشكالات الناجمة عن مسح العقارات غير المبنية المثبتة بسند مشهر

Résumé: ملخص: يتناول هذا البحث دراسة الإشكالات القانونية التي تنجم عن عملية مسح العقارات غير المبنية التابعة للخواص والمثبتة بسند مشهر، حيث نجد أن أهم هذه الإشكالات هي تسجيل العقارات التي لا يظهر أصحابها في حساب مجهول(حساب العقارات غير المطالب بها)، رغم المحاولات العديدة التي قام بها المشرع الجزائري لحل هذه الإشكالية تحديدا إلا أنه لم يوفق كليا في حلها. هذا وقد حاولنا من خلال بحثنا هذا الإجابة على إشكالية تتمحور حول كيفية تعامل المشرع الجزائري مع حالة مسح العقارات وتسجيلها في حساب العقارات غير المطالب بها(حساب مجهول) ومدى توفيقه في ذلك، حيث انتهجنا في سبيل الإجابة عليها كلا من المنهجين الوصفي والتحليلي وذلك لكونهما الأنسب لمثل هذه الدراسات. Abstract: This study deals with the legal problems that result from the survey of unconstructed properties belonging to the properties and proven by a famous bond. The Algerian legislator solved this particular problem, but he did not fully succeed in solving it. In this research, we tried to answer the problem centered on how the Algerian legislator deal with the status of real estate survey and registration in the account of unclaimed real estate (anonymous account) and the extent of success in this, where we have taken in order to answer them both descriptive and analytical approaches for being the most appropriate For such studies.
