التوجه التشريعي نحو حوكمة الصيرفة الإسلامية في ظل القواعد القانونية المستحدثة

Résumé: تهدف هذه الدراسة إلى الوقوف على معنى الحوكمة في المجال المصرفي بصفة عامة، و مدى تطبيقها في المصارف الإسلامية التي أخذت اهتمام المشرع في الآونة الأخيرة، و كذا مدى فعاليتها في تحسين الآداء المالي للبنوك الإسلامية الجزائرية و جلب المجتمع في مباشرة التعامل معها. و قد حصلت الدراسة إلى أن الحوكمة المصرفية تعتبر نتيجة للقواعد القانونية الراجحة في المجال المصرفي، حيث سعت الإرادة التشريعية تمديد قواعدها و مبادئها إلى مجال الصيرفة الإسلامية، مع توفير الوسائل اللازمة لضمان احترام حوكمة المصارف الإسلامية بداية من تأسيسها استنادا للدور الرقابي الذي يمارسه بنك الجزائر مرورا بكل خدماتها بشكل متزامن، عن طريق الرقابة عليها من طرف هيئة الرقابة الشرعية و كذا الهيئة الوطنية للإفتاء في الصناعة المالية و الإسلامية. This study aimed to determine the meaning of governance in the banking field in general, and the extent of its application in Islamic banks that have recently received the attention of the legislator, as well as the extent of its effectiveness in improving the financial performance of Algerian Islamic banks and brining the community to deal with them. This study concluded that banking governance is considered a result of successful legal rules in the banking field, As the legislative will sought extend its rules and principles tp the field of Islamic banking, while providing the necessary means to ensure respect for the governance of Islamic banks, starting for their establishment based on the supervisory role exercised by the Bank of Algeria, passing through its services simultaneously, Through supervision by the sharia supervisory Board, as well as the national authority for fetwa in the financial and Islamic industry.
