إجراءات التقاضي باستخدام الذكاء الاصطناعي مقاربة فقهية قانونية

Résumé: قدم البحث مقاربة فقهية قانونية تناولت الموقف من إجراءات التقاضي باستخدام الذكاء الاصطناعي، بعد أن أصبح الذكاء الاصطناعي عاملاً هاماً في مجال العدالة المعاصرة، ويهدف البحث إلى تحديد النطاق الذي يمكن في حدوده استخدام الذكاء الاصطناعي في إجراءات التقاضي، ومدى ملائمة ذلك لحقوق الأفراد وحرياتهم، وبيان مدى ناجعة استخدام الذكاء الاصطناعي والاستعانة في تحقيق محاكمة عادلة، وجدوى استقلاله بالقيام بإجراء من إجراءات التقاضي بشكل مستقل عن البشر، وقد خلُص البحث إلى أن الأصل في استخدامات الذكاء الاصطناعي الإباحة، وتدور على استخداماته الأحكام التكليفية الخمسة، وأنه رغم مساهمة الذكاء الاصطناعي في ترف البشرية ورفاهيتها ورفع جودة العمل القضائي وتقليص أمد التقاضي وتحقيق العدالة الناجزة؛ فإن أهم مخاطره تكمن في الخشية من استقلاله وفقدان السيطرة عليه من قبل البشر، كما أنه من غيرالمقبول التسليم باستقلال الذكاء الاصطناعي بولاية القضاء وإصدار الأحكام القضائية، فهو أداة معاونة ومساعدة ليس إلا. The research presented a legal and jurisprudential approach regarding the stance on litigation procedures using artificial intelligence, as AI has become an important factor in contemporary justice. The aim of the research is to define the limits within which AI can be used in litigation processes, and the extent to which this is suitable for individual rights and freedoms. It also addresses the effectiveness of using AI to achieve a fair trial and the feasibility of it independently carrying out litigation procedures without human involvement. The research concluded that the default stance on the use of AI is permissibility, governed by the five rules of obligations. While AI contributes to enhancing human welfare, improving the quality of judicial work, reducing the duration of litigation, and achieving prompt justice, its major risks lie in the fear of its independence and loss of control over it by humans. Furthermore, it is unacceptable to concede to AI having jurisdictional authority and issuing judicial rulings; it is merely an assisting tool.
