Résumé: إن جوهر العقد و أساس وجوده هو تلاقي إرادة المتعاقدين ،و من هذا التلاقي ينشأ التراضي الذي يمثل أساس كل إتفاق ،كما أن تحديد مضمون العقد و تعديله و إنهائه مرده في أغلب الأحيان إلى إرادة طرفيه ،و قد يتدخل المشرع في توجيه هذه الإرادة بالقدر الذي يسمح بتوفير الاستقرار في المراكز القانونية و إحداث التوازن في العقود و كذا حماية الإرادة ذاتها لما لها من دور في المجال التعاقدي. الكلمات المفتاحية: مبدأ سلطان الإرادة – الحرية التعاقدية – تقييد الإرادة- تعديل العقد. Summary : Contract essence and its existence are justified by the meeting of contractor will. This meeting emerges consent which represents the basis of every agreement .As determination and cancellation are usually done by the two parts . In addition ; the legislator can intervene to guide the will in order to stabilize lawful positions and to balance contracts.Thus he protects the will-itself-because of the role that played in contractual field Key words : The principal of will independence – The contractual freedom- The will – restriction – The contract modification.
