المحاكم التجاريّة المتخصّصة في القانون الجزائري

Résumé: يتطلّب تنظيم المعاملات التجارية قواعد نوعية، كما أنّ تطبيق هذه القواعد على النّحو المطلوب بغية الارتقاء بالمعاملات التجارية والاقتصادية وجعلها تستجيب للتطلعات وتصمد أمام التحديات، يقتضي بالضرورة إيكال مهمّة الفصل في كل ما يثور عنها من منازعات لاسيما النوعية منها، إلى قضاء على الأقل متخصّص. هذا المطلب في الواقع طالما نادوا به المتعاملين الاقتصاديين على المستويين الداخلي والدولي، وقد بدت بوادر الاستجابة له من خلال تكريس وتنصيب محاكم تجارية متخصّصة في بعض المنازعات دون سواها؛ وهو ما يعتبر نقلة نوعية من أجل تحسين أداء القضاء، يتعيّن ولو بعد حين ضبط أحكامه أكثر واستكمالها، من أجل خلق قضاء تجاري مستقل بالموازاة إلى القضاء العادي. Regulation of commercial transactions requires qualitative rules, and the application of these rules to the extent required in order to improve business and economic transactions and make them responsive to aspirations and meet challenges necessarily requires that all disputes arising, especially quality, be adjudicated to at least a specialized judiciary. This requirement has in fact been advocated by economic dealers at both the domestic and international levels and has appeared to be a source of response through the establishment and installation of commercial courts specializing in certain disputes; This is a qualitative shift in order to improve the functioning of the judiciary, even if its provisions are to be further regulated and supplemented, in order to create an independent commercial judiciary in parallel to the ordinary judiciary.
