Résumé: الملخص: يهدف هذا البحث إلى بيان سلطة القاضي في تعديل وفسخ عقد الإجارة في الظروف الطارئة، وهذه الدراسة دراسة فقهية مقارنة بقانون دولة الإمارات العربية المتحدة، وذلك من خلال التعريف بالظروف الطارئة؛ وماهية عقد الإجارة، والتكيف الفقهي والقانوني له، وبيان سلطة القاضي في تعديل العقد في الظروف الطارئة. وقد استقامة دراستها من خلال تمهيد وجانبين: في التمهيد التعريف بنظرية الظروف الطارئة، وفي الجانب الأول: بيان ماهية عقد الإجارة تعريفه وتكييفه الفقهي، وفي الجانب الثاني: بيان دور القاضي في تعديل وفسخ عقد الإيجار بناء على الظروف الطارئة. وقد كشف البحث بجلاء أن الشريعة الإسلامية قد سبقت القوانين الوضعية في نظرية الظروف الطارئة بشكل عام والاعذار الموجبة لفسخ عقد الايجار بشكل خاص، وأن قانون المعاملات المدنية لدولة الامارات العربية المتحدة قد راعى وجود الظرف الطارئ في نصوصه. Abstract: This study aims to demonstrate the authority of the judge to amend and annul the lease contract in emergency circumstances. Furthermore, the nature of the lease contract, its jurisprudence and legal adaptation, and the statement of the judge's authority to amend the contract in emergency circumstances. Its study straightened through an introduction and two aspects: in the introduction, the definition of the theory of emergency circumstances, and in the first aspect: an explanation of the nature of the lease contract, its definition, and jurisprudential conditioning and in the second aspect: an indication of the role of the judge in amending and annulling the lease contract based on emergency circumstances. The research revealed that the Islamic Sharia preceded laws in the theory of emergency circumstances in general and the excuses for terminating the lease contract in particular and that the Civil Transactions Law of the United Arab Emirates took in to account the existence of the emergency circumstance in its texts.
