الطفولة المسعفة بين تأكيد الحقوق وتوفير الحماية

Résumé: إن الطفل المسعف هو فرد من المجتمع يستحق أن يعيش مثله مثل الطفل العادي ، من حقه أن تدرج له حقوق وتوفر له حماية، والملاحظ أن التشريعات الدولية والوطنية أولت اهتماما بهذه الفئة من الأطفال والظاهرة لما لهذه الأخيرة من خطورة على المدى القريب والبعيد، حيث أكدت هاته التشريعات على جملة من الحقوق ذات الطابع الخاص، وحاولت جاهدة إيجاد مراكز ومؤسسات وحلول بديلة من أجل احتوائهم وتقديم لهم الرعاية والاندماج في المجتمع رغم كل النقائص والانتقادات، وهذا ما سنحاول التعرض إليه في هذه الورقة، بتسليط الضوء على أهم الحقوق وآليات الحماية التي سخرتها الدولة من أجل هذه الفئة المستضعفة. كلمات مفتاحية: طفل، جريمة، حقوق، حماية، قانون دولي، التشريع الجزائري.: The rescued child is a member of society who deserves to live like an ordinary child. As well as to have rights and protection. It is noted that international and national legislations paid attention to this category of children, which is apparent because of the danger of the latter in the short and long term. These legislations affirmed a number of rights of a special nature and tried to find alternative centres, institutions, and solutions to contain them, provide them with care and integrate them into society, despite all the shortcomings and criticisms. In this regard, the current paper sheds light on the most important rights and protection mechanisms that the state has harnessed for this vulnerable group.
