حكم توريث الزوجة من المفقود بين الفقه الإسلامي وقانون الأسرة الجزائري

Résumé: جاءت الشريعة الإسلامية بخطوة متقدّمة في حفظ حقوق المرأة خاصة مسألة توريث الزوجة من المفقود، حيث اعتبرته حق مقدّس مردّه حكم الله عزّ وجلّ، هذا الأمر تلقّفه قانون الأسرة الجزائري ونظمه في نصوصه عطفا عما صدر باسم الشريعة الإسلامية، لكن تبقى هذه المبادرة ذو فعالية محدودة بحكم قصورها في تنظيمه تنظيما كافيا. وبالتالي سلّط هذا البحث الضوء على آراء المذاهب الفقهية الغزيرة فيما يخص وقت اعتبار المفقود ميتا ومن ثم أيلولة التركة وكذلك كيفية استرداده إذا ظهر حيا على زوجته في مقابل نصوص قانونية سطحية لا تفي بالغرض المقصود منها. Islamic shari’a came step forward in maintaining women’s rights especially the matter of wife inheritance from the missing person, which considered it an sacrosanct right because of almighty god judgment, that was organized by Algerian family law in its texts pursuant to what the shari’a said, but this initiative remains limited effectiveness in reason of their sufficiently lack organization, so this research highlighted about the views of Islamic schools torrential, concerning the moment when a missing person is considered dead and therefore the devolution of his inheritance, as well as how to recovered it if he shows up alive on his wife, in exchange for surface legal texts do not meet for which they are intended
