Résumé: بالنظر لما قد يحتله إصلاح أحكام الإفلاس في الجزائر من أهمية كبرى في تحسين بيئة الأعمال وتمهيد الطريق لتوفير ظروف محفزة للاستثمار، تسعى هذه الدراسة إلى إلقاء الضوء على واقع أحكام الإفلاس في الجزائر بنظرتها الكلاسيكية، من خلال تحليل آليات تفعيل تلك الأحكام والوقوف على مظاهر محدوديتها في ظل الكتاب الثالث من القانون التجاري الجزائري، ثم البحث عن أهم المرتكزات التي استندت عليها التوجهات الجديدة في قوانين الإفلاس الحديثة من خلال الوقوف على بعض القوانين الغربية (الأمريكي، الفرنسي) والعربية(التونسي، المغربي، السعودي) ،لتكون بمثابة آفاق لتعديل أحكام الإفلاس في الجزائر. Abstract: considering the great importance that Reform of bankruptcy provisions in Algeria may have in improving the business environment and paving the way for investment-stimulating conditions; This study seeks to shed light on the reality of bankruptcy provisions in Algeria with its classic view by identifying the mechanisms of their activation and standing on the manifestations of their limitations in the light of the third book of the Algerian Commercial Law, then search for the most important pillars on which the new trends were based in modern bankruptcy laws by standing on some Foreign laws (American, French) and Arab (Tunisian, Moroccan, Saudi), So it's like prospects for amending bankruptcy provisions in Algeria.
